1. Agreement to Terms

By accessing or using GiftShopper.ai ("Service"), operated by DiversifiedFun LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

GiftShopper.ai is a smart gift recommendation platform that helps users discover personalized gift ideas. Our Service uses artificial intelligence to analyze user inputs and generate tailored gift suggestions. We also provide links to third-party retailers where users may purchase recommended items. Many of those links are Amazon affiliate links (see Section 10).

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.

You are responsible for:

• Safeguarding the password used to access the Service
• Any activities or actions under your account
• Notifying us immediately upon becoming aware of any breach of security or unauthorized use of your account

You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity without appropriate authorization.

4. Pricing

GiftShopper.ai is currently free to use:

• Visitors receive a limited number of free gift generations without an account
• Creating a free account removes that limit
• We do not charge for gift generations and do not collect or process payment information
• The Service is supported by affiliate commissions from retailer links (see Section 10)

5. Acceptable Use

The Service is intended for personal use — helping you find gift ideas for people you know. You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Submit false or misleading information
• Upload or transmit viruses or malicious code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use automated systems or software to scrape or extract data without our written consent; automated access must use the official Agent API and must respect its rate limits
• Harvest or store third-party personal data in violation of applicable privacy law
• Resell, redistribute, or commercially exploit the Service without authorization
• Use the Service for any illegal or unauthorized purpose

Agent API Acceptable Use

If you access the Service programmatically via the Agent API or MCP interface, you must: (a) authenticate with a valid API key or OAuth token, (b) stay within the 60-requests-per-minute rate limit, (c) use the API only on behalf of accounts you are authorized to act for, and (d) not use the API to build a competing gift-recommendation product without our prior written consent.

6. Data You Enter About Other People

When you save a recipient profile ("Person"), you are entering personal information about a third party. You represent and warrant that:

• You have a legitimate reason to store this information and have obtained any consent required by applicable law
• You will not enter sensitive personal data (such as financial, health, or government ID information) about other people
• You will not use the Service to build profiles on individuals without their knowledge in a way that violates their privacy rights

7. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of DiversifiedFun LLC and its licensors. The Service is protected by copyright, trademark, and other laws.

Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

8. User Content

You retain ownership of any content you submit to the Service, including gift recipient descriptions, feedback, and preferences ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and store such content solely for the purpose of providing and improving the Service.

You represent and warrant that you have the right to submit any User Content and that such content does not violate any third-party rights.

9. AI-Generated Recommendations

Our Service uses artificial intelligence to generate gift recommendations. To do this, the recipient details you provide are sent to a third-party AI provider (currently Google’s Gemini models) to produce those suggestions — see our Privacy Policy for the full list of processors. You acknowledge and agree that:

• AI recommendations are suggestions only and are provided as-is, without warranty of suitability, availability, or price accuracy
• We do not guarantee the accuracy, availability, or pricing of recommended products
• Product information may change without notice on third-party retailer sites
• We are not responsible for the quality or delivery of products purchased from third parties
• AI systems may occasionally produce unexpected or inappropriate results

10. Affiliate Links Disclosure

Many gift links provided by GiftShopper.ai are Amazon affiliate links. When you click a link and make a qualifying purchase, we may earn a commission at no additional cost to you. This relationship does not influence which gifts are recommended — suggestions are generated by AI based solely on the recipient information you provide.

11. Third-Party Links and Services

Our Service contains links to third-party websites and services, including online retailers. We are not responsible for:

• The content, privacy policies, or practices of third-party sites
• Products or services offered by third parties
• Any transactions you conduct with third parties
• Any damages or losses caused by third-party sites or services

We strongly advise you to read the terms and privacy policies of any third-party websites you visit.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DIVERSIFIEDFUN LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

14. Indemnification

You agree to defend, indemnify, and hold harmless DiversifiedFun LLC and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of the Service or your violation of these Terms.

15. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason including without limitation if you: breach these Terms, engage in abusive scraping, exceed API rate limits in a manner that degrades service for others, or violate the Agent API acceptable use requirements.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so through your account settings or by contacting us.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida, USA. You consent to personal jurisdiction in those courts.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

17. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede any prior agreements.
